We know that reading terms and conditions is pretty boring, and we do not have any hidden agendas, or other unpleasant surprises. We are always here to talk to in the unlikely event of a problem. But please still take your time to read these Terms & Conditions (“terms”, “terms and conditions”) .

‘We’, ‘us’ or ‘our’ used in this document means upXycled.

These terms and conditions set out your rights when you use upXycled.com and by using our website you agree to our terms and conditions (this document) as well as to our Privacy Policy.

Please read these terms and conditions carefully before using the upXycled.com website (the “Service”) operated by upXycled. Your access to and use of the Service is conditioned upon your acceptance of and compliance with these terms and conditions. These terms and conditions apply to all visitors, users, customers and sellers and others (even if you are just browsing our website) who wish to access or use the Service. By accessing or using the Service you agree to be bound legally by these terms and conditions.

By agreeing to these terms and conditions, you agree to resolve all disputes through binding individual arbitration, which means that you waive any right to have those disputes decided by a judge or jury, and that you waive your right to participate in class actions, class arbitrations, or representative actions.

If you don’t agree with these terms and conditions, you may not use our Services.

These terms and conditions always take precedence over the Store Policies defined by the sellers in their stores thus sellers cannot decide to deviate from these terms and conditions unless they want to provide better terms and conditions than specified here.

To shop at upXycled.com you must be 18 years or older. Minors under 18 and at least 13 years of age are only permitted to use our Services through an account owned by a parent or a legal guardian with their appropriate permission and under their direct supervision. Children under 13 years are not permitted to use our Services. You are responsible for any and all account activity conducted by a minor on your account.

The website default currency is Euro (€) which is the currency used by our sellers to set their product and shipping prices. Based on your location you may see prices quoted in other currencies than Euro (€). You can manually change the quoted prices to your preferred currency in the top menu bar. However, as indicated in red text when you proceed to the Checkout you will be paying in Euro (€), so all though the prices you see in other currencies should be pretty accurate you may experience small fluctuactions in the amount withdrawn from your bank account due to the actual exchange rates at the moment you place your order.

Unless a seller provides free shipping to your location the shipping costs are stated prior to approval of your purchase.

In case you get a message when viewing a product saying ‘Sorry this item does not ship to your location. You may contact the seller to understand whether shipping can be enabled!‘ the seller does not ship the product to your destination and you cannot add the product to the Cart.

Notice if you purchase from a seller located in a different country than your country of residence you may have to pay additional import taxes and customs duties/fees before the goods are handed over to you by the freight company. For instance if you live in an EU country and purchase from a United States (US) based seller you will likely have to pay EU import VAT and customs duties if the total order amount including shipping exceeds €150.
The store location is visible when you view a product including a notice informing you that import taxes and customs duties may be claimed by the freight company, before they can hand out the parcel to you.

In general, you as the buyer are responsible for paying the additional costs such as duties, taxes, and customs clearance fees. These charges can vary widely and are often based on the price, type of item, package weight/dimensions, country of origin, as well as the taxes, duties, and fees of the destination country.

Most sellers on upXycled.com cannot predict which of these fees, if any, will be applied, and upXycled doesn’t expect sellers to calculate or collect these fees or taxes.

upXycled is not responsible for any additional charges that may apply after a purchase is completed.

Sellers product prices are subject to price changes, sold out products, currency changes and force majeure.

All product and shipping prices are where applicable displayed including sales taxes (value added taxes or sales taxes which may also in some countries be known as VAT, JCT, GST, SST or QST).


You can pay with the most common types of payment cards like Visa, Mastercard, Maestro, American Express, UnionPay and JCB as well as with Apple Pay, Google Pay, Sofort, iDEAL, Przelewy24, Klarna, Bancontact, Giropay, EPS or Multibanco (availabillity of some of these payment methods depends or your country).

All though you can display approximate product and shipping prices in other currencies than our default currency Euro (€), all payments during Checkout are made in Euro (€). Be aware that if you bank account currency is not Euro (€) you will have to pay an exchange fee for converting from your currency to Euro (€). This is also the case if a seller fully or partly refund you after a purchase.

Entered credit card or other payment method information is encrypted with SSL encryption (Secure Sockets Layer), and cannot be read by upXycled or the seller.
Payment via credit card, Apple Pay, Google Pay, Sofort, iDEAL, Przelewy24, Klarna, Bancontact, Giropay, EPS or Multibanco are securely done via Stripe. You do not pay the transaction fees on these payment transactions.

We cannot withdraw more than the amount that you have accepted during Checkout.

We or the sellers reserve all rights to refuse an order. This can be done by incomplete information, suspected abuse, or fraud with the payment method. In that case we or the seller will contact the stated email address, or telephone number.

As a customer or a seller you are welcome to contact us using the contact form Contact Us to inquire whether we can support additional countries.

In case you get a message when viewing a product saying ‘Sorry this item does not ship to your location. You may contact the seller to understand whether shipping can be enabled!‘ the seller does not ship the product to your destination and you cannot add the product to the Cart.

You may contact the seller to understand whether rules for your location can be configured allowing you to submit an order for the item.

If you have relevant comments to the seller, it is a good idea to write this in ‘Order notes’ field when placing your order.

It is up to the sellers to decide which freight company they will use to send parcels. Parcels should be sent as traceable and the seller should provide you Track and Trace information as soon as the parcel is handed over by the seller to the freight company.

The delivery is considered completed when the receiver (normally you unless you specified your order to be sent to somebody else) has been entrusted the items ordered.

The receiver must examine the items immediately upon receipt and in this regard verify that the items are undamaged and correspond to the carried out order.

If the recipient has an agreement with the freight company allowing them to deliver parcels without a signature from the recipient, the delivery is considered completed when the freight company has marked the shipment as delivered to the desired address.

Ordering and order receipt

Purchases from upXycled.com are carried out by following these simple steps:

  • Locate the item or items you want to buy from a seller or multiple sellers by searching or by browsing the Marketplace
  • For each item select the desired quantity and click the ‘ADD TO CART’ button
  • Once you have added all the items you want to purchase, go to the ‘Cart’ page and confirm the selected items, quantities and shipping method (in case you are presented with different shipping methods) and click the ‘PROCEED TO CHECKOUT’ button
  • In case you have shopped with us before, and you at that time chose to create an account select ‘Do you already have a Customer Account? Click here to login.’, or if you want to login using Facebook or other social media, select ‘Or login using your preferred Social Account? Click here to login.’
    Logging in is strongly recommended since it automatically obtains your information and stores the order under your account
  • In case you have a coupon select ‘Do you have a Coupon? Click here to enter your Coupon Code.’ and enter the coupon code
  • Fill in/confirm all required and if applicable optional fields under ‘Billing details’ and optionally write comments you may have to the seller in the ‘Order notes’ field
  • If you have not previously created an account optionally tick ‘Create an account?’ and fill in your desired username and password (both the email address and the username combined with this password can be used later to login)
  • If you want the items to be sent to another address tick the ‘Ship to a different address?’ and fill in all required and if applicable optional fields
  • Select your preferred payment method and provide the required information
  • Tick ‘I agree to upXycled’s Privacy Policy and Terms & Conditions’
  • If you want to subscribe to our newsletter tick ‘Subscribe to our newsletter (max 1 per month with offers only for subscribers)’
  • Submit your order by clicking the ‘PLACE ORDER’ button, or by clicking the Apple Pay or Google Pay button in case you pay with either of these

If you selected to create an account, or if you logged in via Facebook or other social media, it will be possible later to view your current and past orders by selecting the link ‘Login’ in the top menu bar.

Approval of your order

Shortly afterwards submitting the order you should receive an email confirming that the seller, or the sellers in case your order included items from different sellers, has received your order (in case you don’t receive it within reasonable time, please contact us using the contact form Contact Us asking us to resend it). The email contains information about which items you have ordered.

The email is only an acknowledgment of receipt the seller/sellers has received your order and both upXycled as well as the seller/sellers reserve the right to cancel your order if:

  • Errors are found in the listed prices
  • Other misprints occur
  • Technical problems occur
  • Suppliers fail
  • Force majeure
  • Incomplete information provided by customer
  • Fraud with the payment method is suspected
  • Other similar situations apply that affects the sellers ability to deliver the requested item(s)

A final order completion email will be sent to you once the seller, or the sellers in case your order included items from different sellers, has shipped your parcel(s) and provided you the track and trace information.

If your order delivery is delayed

If, after a reasonable time, you or the recipient you specified have not received the parcel, please first try to contact the freight company referring to the tracking number provided by the seller. In case of problems contacting the freight company, then contact the seller or alternatively us using the contact form Contact Us, so the seller or we can investigate with the freight company why the parcel has not yet been delivered.

Right to cancel your order

In EU buyers are protected by laws allowing up to 14 days after receiving an order to return item(s) from the order. To treat all buyers equally and because we find 14 days to return item(s) good customer service all buyers at upXycled.com also non-EU residents have this same right of cancellation and our sellers cannot decide to deviate from this rule by stating otherwise in their Store Policies (if sellers should state otherwise in their Store Policies these terms and conditions always take precedence).

Exception to above rule is if a buyer decides to pickup an order at the seller’s store address. In that case the 14 days right to cancel the order do NOT apply unless the seller has specifically added to the Store Policies that the 14 days do also apply for local pickups.

Application of cancellation right
If you want to regret your purchase before the seller has shipped your order, please immediately contact the seller specifying the reason why you want to regret your purchase.
If the parcel has been shipped by the seller and you or the recipient refuse to receive the parcel from the freight company forcing the freight company to return the parcel to the seller the seller must refund you the full purchase amount including any original shipping costs in Euro (€).
However, any shipping costs added by the freight company for returning the parcel to the seller claimed to the seller by the freight company, will be deducted from the amount you are refunded meaning you as the buyer always pay for the return shipping costs.

Likewise if the parcel has been handed over to you, or to the recipient by the freight company and you or the recipient decide to return any item(s) you pay the shipping cost for returning the item(s) to the seller.

If the returned item(s) are not in the same condition as when shipped by the seller the seller will generally only make a partial or no refund of the paid amount (the seller should provide you the reason why you are not fully refunded).

We definitely recommend that items being returned are sent back to the seller as a traceable parcel (remember to get a receipt). If you or the recipient choose to return the parcel without a receipt and the parcel is lost before reaching the seller, the full responsibility lies with you and you will not be refunded by the seller.

Your right to complain

You or the recipient must immediately upon receipt of the parcel and before the item(s) are taken into use make sure the item(s) are as ordered, free of defects and in the correct ordered quantity. Any complaints must be made to the seller within reasonable time after the shortcoming is, or should have been discovered by you or the recipient.

In the situation of a just claim generally the seller unless stated otherwise in the seller’s Store Policies should exchange wrong or defective items with equivalent items. If possible the seller can also decide to repair defective items. If neither exchange or repair is possible the seller can also decide to refund you.

Reasonable expenses held by you for returning wrongly delivered or defective items to the seller, must be refunded to you by the seller.

Acceptance of the complaint is conditioned by your complaint to the seller being justified. If the defect/shortcoming is clearly caused by misuse, abuse, modifications or other destructive behaviour the seller may and probably will not accept the complaint.

Any dispute regarding a complaint between you as the customer and the seller can be escalated to upXycled by contacting us using the contact form Contact Us.

Please refer to below section further complaints for instructions how to complain about a seller, or upXycled in case a mutual acceptable agreement cannot be found.

Application of complaints
Before you return any wrongly delivered or defective items to the seller based on a complaint, please first send a detailed description of the nature of the complaint to the seller and await response from the seller.
In case of a defect/shortcoming please attach pictures to your communication (will speed up the processing of your complaint).

Please hold returning any items to the seller until the seller has confirmed you should do so.

Electronic communications

We send order received confirmations as well as final order completed confirmations via email by which this information is not sent as physical letters.

Your order received confirmation is sent once your order is submitted to the seller/sellers, while final order completed confirmation is sent when the seller, or the sellers in case your order included items from different sellers, has sent your order and provided you the track and trace information.

Warranty and liability

upXycled do not provide any warranty since we don’t manufacture, store or physically inspect any of the items sold by independent sellers through our website. Thus upXycled do not guarantee the items are of good quality, safe or legal. Any warrantly related claims are between you as the buyer and the seller.

By making a purchase on upXycled.com you consent that any claims are between you and the seller thus upXycled cannot be held responsible for any claims.

Likewise you cannot hold upXycled responsible for items or information provided by a seller which you find offensive or inappropriate. However, we urge you to immediately report such findings to us using the contact form Contact Us allowing us to take actions against the seller in case we agree with you.

Security, privacy information and cookies

Our entire website inclusive the Checkout and payment methods is encrypted using SSL encryption (Secure Sockets Layer) and thus all communication between you and the upXycled.com website is secure and only visible to you the seller and us.

Both upXycled and our sellers process personal information (for example name, email address, and shipping address) and are therefore considered separate and independent data controllers of buyers’ personal information under EU law. That means that each party is responsible for the personal information it processes. For example, if a seller accidentally discloses a buyer’s name and email address when fulfilling another buyer’s order, the seller, will be fully responsible for that unauthorized disclosure.

All information you provide to upXycled, will be kept strictly confidential by upXycled and must likewise be kept strictly confidential by the seller and should at no time be shared, sold or otherwise made available to other with these exceptions:

  • Name, address, email address and phone number are disclosed with Stripe for payment via credit card, Apple Pay, Google Pay, Sofort, iDEAL, Przelewy24, Klarna, Bancontact, Giropay, EPS or Multibanco
  • Name, address and phone number are disclosed with the freight company used by the seller

We do not store credit card information or information about the other payment methods of any kind and your payment information is not visible to upXycled or to the seller at any time.

We only store the necessary information to complete your order and to allow you to see your order history if you choose to create an account with us, or to login using Facebook or other social media.
